1. ACCEPTANCE OF TERMS

1.1 Binding Agreement

By accessing, browsing, or using the Service in any manner, including but not limited to visiting or browsing the website, submitting a vehicle listing, creating an account, or making a payment, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. This Agreement takes effect the moment you first access the Service.

1.2 Age Requirements

You must be at least eighteen (18) years of age to use this Service. By using NoCarScam, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this binding Agreement. If you are under 18, you may not use this Service under any circumstances. We do not knowingly collect or solicit personal information from anyone under the age of 18.

1.3 Legal Authority

If you are entering into this Agreement on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms. In such cases, “you” and “your” shall refer to such entity.

1.4 Updates to Terms

We reserve the right to modify, amend, or update these Terms at any time in our sole discretion. When we make material changes, we will notify you by: (a) posting a prominent notice on our website, (b) updating the “Last Updated” date at the top of these Terms, and/or (c) sending you an email notification to the address associated with your account. Your continued use of the Service after any modifications indicates your acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of the Service immediately.

1.5 Electronic Agreement

You consent to receive this Agreement and all related documents electronically. You agree that electronic agreements have the same legal effect as written agreements signed by hand.

2. SERVICE DESCRIPTION

2.1 Overview of Services

NoCarScam provides a car selling assistance and scam protection service designed to help vehicle owners sell their cars safely and efficiently. Our services include, but are not limited to:

• Multi-Platform Listing: We create and publish professional vehicle listings on your behalf across multiple third-party platforms, including but not limited to Craigslist, AutoTrader, Cars.com, CarGurus, and other automotive marketplaces.
• Privacy Protection: We provide a dedicated phone line to shield your personal phone number from potential buyers, ensuring your privacy throughout the sales process.
• Buyer Screening: We screen and verify potential buyers to filter out scam attempts, unserious inquiries, and suspicious contacts before connecting them with you.
• Safe Meeting Locations: We recommend public, safe meeting locations for vehicle inspections and transactions.
• Vehicle History Reports: All service packages include ClearVin vehicle history reports to build buyer trust and facilitate faster sales.

2.2 Service Tiers

We offer the following service packages:

• Basic ($39): 2+ platform listings, basic buyer screening, email support, 7-day listing period, 1 safe meetup location recommendation, dedicated phone line, dedicated agent, ClearVin report.
• Silver ($99): 4+ platform listings, advanced scam detection, priority support, 15-day listing period, 2 safe meetup location recommendations, dedicated phone line, dedicated agent, ClearVin report.
• Premium ($190): 7+ platform listings, VIP scam protection, 24/7 dedicated support, 15-day listing period, 3 safe meetup location recommendations, dedicated phone line, dedicated agent, graphics design, ClearVin report included.

2.3 What We Are NOT

NoCarScam is NOT a vehicle dealership, broker, escrow service, or financial institution. We do not:

• Purchase, sell, or own any vehicles
• Guarantee the sale of your vehicle
• Handle any money exchange between buyers and sellers
• Provide escrow or payment processing services for vehicle transactions
• Guarantee the authenticity, reliability, or intentions of any buyer
• Inspect, appraise, or certify vehicle condition
• Provide legal, financial, or mechanical advice

2.4 Service Availability

Our Service is currently available to users located within the United States. We make no representations that the Service is appropriate or available for use in other locations. Users who access the Service from outside the United States do so at their own risk and are responsible for compliance with local laws.

3. USER ACCOUNTS & REGISTRATION

3.1 Account Creation

To access certain features of the Service, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information as requested during the registration process
• Maintain and promptly update your account information to keep it accurate, current, and complete
• Provide a valid email address that you have access to
• Create a strong password that you do not use for other online accounts

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to:

• Keep your password secure and confidential
• Not share your account credentials with any third party
• Immediately notify us of any unauthorized access to or use of your account
• Log out of your account at the end of each session, especially on shared devices
• Accept full responsibility for all activities that occur under your account

We shall not be liable for any loss or damage arising from your failure to protect your account credentials.

3.3 One Account Per Person

Each user may maintain only one (1) active account. Creating multiple accounts to circumvent restrictions, abuse promotions, or for any other purpose is strictly prohibited and may result in immediate termination of all associated accounts without refund.

3.4 Account Verification

We reserve the right to verify your identity and the accuracy of your registration information at any time. You agree to cooperate with any identity verification procedures we may implement.

4. USER CONDUCT & PROHIBITED ACTIVITIES

4.1 Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must:

• Provide truthful and accurate information about yourself and your vehicle
• Have legal ownership or authorization to sell any vehicle you list through our Service
• Ensure your vehicle has a clean, transferable title (unless disclosed otherwise)
• Accurately represent your vehicle's condition, history, mileage, and features
• Respond promptly to verified buyer inquiries forwarded by our team
• Conduct all meetings at safe, public locations
• Comply with all applicable federal, state, and local laws and regulations

4.2 Prohibited Activities

You expressly agree NOT to engage in any of the following prohibited activities:

A. Fraudulent or Deceptive Conduct

• Providing false, misleading, or fraudulent information about yourself or your vehicle
• Misrepresenting vehicle condition, mileage, history, or ownership status
• Tampering with or rolling back odometers (federal and state crime)
• Engaging in title washing, VIN cloning, or other fraudulent documentation practices
• Listing vehicles you do not own or have legal authority to sell
• Listing stolen, salvaged (undisclosed), or illegally imported vehicles

B. Abusive or Harmful Behavior

• Harassing, threatening, or intimidating our staff or other users
• Using profane, vulgar, or abusive language in communications
• Stalking, doxxing, or publishing private information of others
• Discriminating against others based on race, color, religion, sex, national origin, disability, age, or any other protected characteristic

C. Technical Abuse

• Attempting to gain unauthorized access to our systems, servers, or databases
• Using bots, scrapers, or automated tools to access the Service
• Introducing viruses, malware, or other harmful code
• Attempting to reverse engineer, decompile, or disassemble any part of the Service
• Interfering with or disrupting the integrity or performance of the Service
• Circumventing any security features or access controls

D. Spam and Unsolicited Communications

• Sending spam, chain letters, or unsolicited promotional materials
• Harvesting email addresses or contact information from other users
• Using the Service to send bulk messages or advertisements

E. Illegal Activities

• Engaging in any activity that violates federal, state, or local laws
• Money laundering or fraudulent financial transactions
• Tax evasion or failure to report vehicle sales as required by law
• Any other criminal activity

4.3 Vehicle Content Guidelines

When submitting vehicle photos and descriptions, you must:

• Submit only photos of the actual vehicle being sold (no stock photos)
• Ensure photos accurately represent the current condition of the vehicle
• Not digitally alter photos to hide defects or damage
• Disclose all known defects, accidents, damage, or mechanical issues
• Not include photos containing inappropriate, illegal, or copyrighted content

4.4 Consequences of Violations

Violation of any prohibited activities may result in:

• Immediate removal of your listing(s)
• Suspension or permanent termination of your account
• Forfeiture of all fees paid without refund
• Legal action, including reporting to law enforcement authorities
• Civil liability for damages caused to NoCarScam or third parties

5. INTELLECTUAL PROPERTY RIGHTS

5.1 Our Intellectual Property

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by NoCarScam, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The NoCarScam name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of NoCarScam or its affiliates. You may not use such marks without our prior written permission.

5.2 User-Generated Content License

By submitting, posting, or displaying content (including vehicle photos, descriptions, and any other materials) through the Service (“User Content”), you grant NoCarScam a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in connection with operating and providing the Service.

This license includes the right to post your vehicle listing on third-party platforms on your behalf. The license continues for as long as your content remains on our Service and a reasonable time thereafter for backup and archival purposes.

5.3 Your Representations

You represent and warrant that:

• You own or have the necessary rights to submit the User Content
• Your User Content does not infringe upon the intellectual property rights of any third party
• Your User Content complies with these Terms and all applicable laws

5.4 DMCA Copyright Policy

We respect the intellectual property rights of others and expect users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond to notices of alleged copyright infringement that comply with the DMCA.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information:

• A physical or electronic signature of the copyright owner or authorized agent
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material alleged to be infringing and its location on our Service
• Your contact information (address, telephone number, and email)
• A statement that you have a good faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information in the notice is accurate

5.5 Limited License to Users

Subject to your compliance with these Terms, NoCarScam grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use only.

6. PAYMENT TERMS

6.1 Pricing

All prices are displayed in United States Dollars (USD) and are subject to change without notice. Current pricing is as follows:

• Basic: $39.00 (one-time)
• Silver: $99.00 (one-time)
• Premium: $190.00 (one-time)
• Listing Extension: $75.00 per month (if applicable)

Prices do not include any applicable sales tax, which will be calculated and added at checkout based on your location.

6.2 Payment Methods

We accept the following payment methods:

• Major credit cards (Visa, MasterCard, American Express, Discover)
• Debit cards with Visa or MasterCard logo
• PayPal

By providing payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge the full amount to that payment method.

6.3 Payment Processing

Payment processing services are provided by third-party processors (Stripe and/or PayPal). By using our Service, you agree to be bound by the applicable payment processor's terms of service. We are not responsible for any errors or failures by the payment processor.

6.4 Billing

All charges are processed immediately upon order submission. You will receive an electronic receipt via email upon successful payment. Our services are one-time purchases and do NOT automatically renew. If you wish to extend your listing after the initial period, you must manually purchase an extension.

6.5 Failed Payments

If your payment fails, your listing will not be created or will be suspended until successful payment is made. We are not responsible for any delays caused by payment processing issues.

6.6 No Commission Fees

NoCarScam does not charge any commission or percentage of your vehicle sale price. You keep 100% of the proceeds from the sale of your vehicle.

7. REFUND POLICY

7.1 30-Day Verified Buyer Guarantee

We offer a 30-Day Verified Buyer Guarantee. If we fail to connect you with at least one verified, serious buyer within thirty (30) days from the date your listing goes live, you are eligible for a full refund of your service fee.

7.2 Eligibility for Refund

To be eligible for a refund under our guarantee, you must:

• Have provided accurate and complete vehicle information
• Have submitted clear, honest photos of your vehicle
• Have responded to all communications from our team within 48 hours
• Not have sold your vehicle through other means during the listing period
• Not have removed your listing before the 30-day period
• Submit a refund request within seven (7) days after the 30-day period ends

7.3 Non-Refundable Situations

Refunds will NOT be issued in the following circumstances:

• You sold your vehicle (through our service or otherwise)
• You decided not to sell or removed your listing
• You declined to meet with verified buyers we connected you with
• You provided inaccurate or misleading information about your vehicle
• You violated any provision of these Terms
• Your vehicle has a branded title (salvage, rebuilt, flood, lemon) that was not disclosed
• Your vehicle is priced significantly above market value (as determined by us)

7.4 How to Request a Refund

To request a refund, email refunds@nocarscam.com with your order number and reason for the refund request. We will review your request and respond within five (5) business days.

7.5 Refund Processing

Approved refunds will be processed to the original payment method within seven to ten (7-10) business days. You will receive an email confirmation when your refund has been processed.

7.6 Chargebacks

If you initiate a chargeback or payment dispute with your bank or payment provider before contacting us to resolve the issue, we reserve the right to: (a) permanently ban your account, (b) refuse future service, and (c) pursue legal action to recover any amounts owed plus associated fees.

8. LIMITATION OF LIABILITY

8.1 Service Provided “As Is”

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

8.2 No Warranties

NoCarScam, its subsidiaries, affiliates, and licensors do not warrant that:

• The Service will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components
• The results of using the Service will meet your requirements
• Your vehicle will sell within any particular timeframe or at all
• All potential buyers will be successfully screened or verified

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NOCARSCAM, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Any vehicle transaction, whether facilitated by our Service or not
• The actions or inactions of any buyer, even if verified by us
• Any scam, fraud, or criminal activity by third parties

8.4 Maximum Liability Cap

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS, DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO NOCARSCAM FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH THE CLAIM AROSE.

8.5 Basis of the Bargain

YOU ACKNOWLEDGE AND AGREE THAT NOCARSCAM HAS OFFERED THE SERVICE AND ENTERED INTO THESE TERMS IN RELIANCE UPON THE DISCLAIMERS AND LIMITATIONS OF LIABILITY SET FORTH HEREIN, WHICH REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK AND FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN US.

8.6 State Law Variations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

9. DISCLAIMERS

9.1 Service Availability

We do not guarantee that our Service will be available at all times. We may experience hardware, software, or other problems, or need to perform maintenance related to the Service, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Service at any time without notice to you.

9.2 Third-Party Platforms

Our Service involves posting listings on third-party platforms (Craigslist, AutoTrader, etc.). We have no control over these platforms and are not responsible for:

• Changes to their terms, policies, or functionality
• Removal or rejection of listings by those platforms
• Technical issues or outages on those platforms
• Any disputes between you and those platforms

9.3 Third-Party Content

The Service may contain links to third-party websites or services that are not owned or controlled by NoCarScam. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that NoCarScam shall not be responsible or liable for any damage or loss caused by use of any such content or services.

9.4 Buyer Screening Disclaimer

While we screen potential buyers to the best of our ability, WE CANNOT AND DO NOT GUARANTEE that all buyers will be legitimate, trustworthy, or that they will complete a purchase. Our buyer screening is designed to reduce the likelihood of scam contacts but cannot eliminate all risk. You are ultimately responsible for your own safety and due diligence when meeting buyers.

9.5 No Professional Advice

The information provided through the Service is for general informational purposes only and does not constitute legal, financial, tax, mechanical, or any other professional advice. You should consult with appropriate professionals before making any decisions regarding your vehicle transaction.

9.6 Vehicle Transactions

NoCarScam is not a party to any transaction between buyers and sellers. We do not guarantee:

• The successful completion of any sale
• The accuracy of any vehicle information provided by sellers
• The condition, quality, or value of any vehicle
• The receipt of payment or valid payment methods used by buyers
• Compliance with any purchase agreement between parties

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless NoCarScam and its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your violation of any third-party right, including any intellectual property, privacy, or publicity right
• Your violation of any applicable law, rule, or regulation
• Your User Content or any content you submit through the Service
• Any misrepresentation made by you regarding your vehicle
• Any transaction between you and any buyer or third party
• Any harm caused to any buyer or third party as a result of your actions
• Any dispute between you and any buyer

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.

11. TERMINATION

11.1 Your Right to Terminate

You may terminate your account at any time by contacting us at support@nocarscam.com. Upon termination, your right to use the Service will immediately cease. Please note that termination of your account does not entitle you to a refund of any fees paid, except as expressly provided in our Refund Policy.

11.2 Our Right to Terminate

We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you:

• Breach any provision of these Terms
• Engage in any prohibited activity
• Provide false, fraudulent, or misleading information
• Fail to pay any applicable fees
• Engage in conduct that we determine, in our sole discretion, to be harmful to other users or our business

11.3 Effect of Termination

Upon termination of your account:

• Your right to access and use the Service will immediately cease
• All active listings will be removed from third-party platforms
• Your dedicated phone line (if applicable) will be deactivated
• You will lose access to your account dashboard and history
• We may delete your account data in accordance with our Privacy Policy

11.4 Data Retention

Following termination, we may retain certain information as required by law or for legitimate business purposes. We may also retain anonymous or aggregated data indefinitely.

11.5 Survival

The following sections shall survive termination of these Terms: Intellectual Property Rights, Limitation of Liability, Disclaimers, Indemnification, Dispute Resolution, and any other provisions that by their nature should survive termination.

12. DISPUTE RESOLUTION

12.1 Informal Resolution

Before initiating any arbitration or legal proceeding, you agree to first contact us at legal@nocarscam.com to attempt to resolve the dispute informally. We will try to resolve the dispute informally by contacting you via email. If the dispute is not resolved within thirty (30) days of submission, either party may proceed with arbitration as set forth below.

12.2 Mandatory Binding Arbitration

If informal resolution fails, you and NoCarScam agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules.

The arbitration shall be conducted in Delaware or, at your election, via telephone or video conference. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.

12.3 Class Action Waiver

YOU AND NOCARSCAM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and NoCarScam agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class, consolidated, or representative proceeding.

12.4 Exceptions to Arbitration

Notwithstanding the above, the following disputes are NOT subject to mandatory arbitration:

• Claims for injunctive or equitable relief
• Claims relating to intellectual property rights
• Small claims court actions (if your claim qualifies)

12.5 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. This choice of law provision is only intended to specify the use of Delaware law to interpret these Terms.

12.6 Venue

For any disputes not subject to arbitration, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware, United States.

12.7 Time Limitation

You agree that any claim arising out of or related to these Terms or the Service must be filed within one (1) year after such claim arose; otherwise, the claim is permanently barred.

12.8 Opt-Out of Arbitration

You may opt out of the arbitration agreement by sending a written notice to legal@nocarscam.com within thirty (30) days of first accepting these Terms. Your notice must include your name, address, email address, and a clear statement that you want to opt out of this arbitration agreement. If you opt out, all other provisions of these Terms will continue to apply.

13. MISCELLANEOUS

13.1 Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and NoCarScam concerning the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written, between you and NoCarScam with respect to the Service.

13.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.

13.3 Waiver

No waiver by NoCarScam of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition, or a waiver of any other term or condition. Any failure by NoCarScam to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your rights or obligations hereunder, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms and our rights and obligations at any time without notice or consent in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.

13.5 Force Majeure

NoCarScam shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond NoCarScam's reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, strikes, labor disputes, shortages of transportation, fuel, power, labor, or materials, failure of third-party platforms, cyberattacks, or any other event beyond our reasonable control.

13.6 Headings

The section headings in these Terms are for convenience only and have no legal or contractual effect.

13.7 No Agency Relationship

No agency, partnership, joint venture, or employment relationship is created as a result of these Terms, and you may not make any representations or bind NoCarScam in any manner.

13.8 Third-Party Beneficiaries

These Terms do not confer any third-party beneficiary rights except as expressly provided herein.

13.9 Language

These Terms are written in English. Any translated versions are provided for convenience only. In the event of any conflict between the English version and any translated version, the English version shall prevail.

13.10 California Residents

If you are a California resident, in accordance with Cal. Civ.
